Terms of Service

Welcome to Motify. These Terms of Service ("Terms") govern your use of the Motify mobile application ("App") operated by Motify ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Motify. By using the App, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age and to terminate accounts that violate this requirement.

2. Your Account

• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate, current, and complete information in your profile.
• You may not create more than one account per person.
• You may not transfer or sell your account to anyone else.

3. Acceptable Use

Motify has zero tolerance for objectionable content or abusive behavior. Any user who violates these rules is subject to immediate account termination. We actively monitor reports and take action within 24 hours.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Harass, bully, stalk, intimidate, threaten, or defame any person.
• Post content that is hateful, violent, sexually explicit, or promotes discrimination.
• Post any content involving minors or child exploitation (CSAM). Violations will be reported to law enforcement and NCMEC.
• Send unsolicited, abusive, or spam messages to other users.
• Impersonate any person or entity, or misrepresent your identity, age, or affiliations.
• Use the App for commercial purposes, advertising, or solicitation without our consent.
• Attempt to reverse-engineer, decompile, or tamper with the App or its Bluetooth protocols.
• Use automated systems, bots, or scrapers to access the App.
• Interfere with or disrupt the App's infrastructure or other users' experience.

4. Content You Post

You retain ownership of the content you submit to Motify (photos, bio, messages). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for operating and improving the App.

We reserve the right to remove any content that violates these Terms without notice. We employ content moderation measures to filter objectionable material and review all user reports within 24 hours. Content found to be in violation will be removed and the offending user's account will be terminated.

5. Reporting and Blocking

• You can report any user for objectionable content or abusive behavior directly from their profile or from a chat conversation. All reports are reviewed by our team within 24 hours.
• You can block any user at any time. Blocking immediately removes the user from your feed and prevents all further interaction. Blocking also notifies our team so we can review the blocked user's behavior.
• When a user is reported, we review the content and take appropriate action, which may include removing the content, issuing a warning, or permanently terminating the offending user's account.
• We encourage you to report any suspicious or inappropriate behavior. Your safety is our priority.

6. Interactions with Other Users

• Motify is not responsible for the conduct of any user, whether online or offline.
• You are solely responsible for your interactions with other users. Exercise caution and good judgment.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using Motify, you consent to the practices described in the Privacy Policy.

8. Bluetooth and Proximity

Motify relies on Bluetooth Low Energy (BLE) to detect nearby users. By using the App, you consent to your device broadcasting and receiving anonymous Bluetooth identifiers. These identifiers are encrypted and cannot be used to track your physical location.

9. Termination

• By you: You may delete your account at any time through the App settings. This will permanently remove your data from our servers.
• By us: We may suspend or terminate your account at any time, without notice, if we believe you have violated these Terms or engaged in behavior that is harmful to other users or the platform. We review all user reports within 24 hours and will remove offending content and terminate the accounts of users who post objectionable content or engage in abusive behavior.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using the App, including finding matches or connections.

11. Limitation of Liability

To the maximum extent permitted by law, Motify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages related to interactions with other users, loss of data, or service interruptions.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law provisions.
